Emergency Rule Making

TCO2 Pre-Race Detention Rule Making (4120.14)

Status:

New York State Racing and Wagering Board has adopted the following emergency rule to amend Harness Rule 4120.14, which was filed with the Department of State on November 10, 2010, and is now in effect. The full Emergency Rulemaking announcement will be published in the State Register on December 1, 2010.

This rule will expire on February 8, 2011. The Board intends to adopt this as a permanent rule. If you wish to comment on this rule, please e-mail Mark Stuart, Assistant Counsel at mark.stuart@racing.ny.gov.

Advance Deposit Wagering Rule Making (5300.4)

Status:

New York State Racing and Wagering Board has adopted the following emergency rule to amend Account Wagering Rule 5300.4, which was filed with the Department of State on December 8, 2010, and is now in effect. The full Emergency Rulemaking announcement will be published in the State Register on December 29, 2010.

Recently Adopted Rules

Harness Preference Rule (4108.8)

Status:

The New York State Racing and Wagering Board has submitted a Notice of Adoption to the New York State Department of State to amend Board Rule 4108.8. This amendment authorizes New York State tracks to write condition or claiming races, as and when appropriate, that restrict entries to horses that have competed in New York State for the majority of their most recent starts. As part of this concept, the rule requires the track to card a race (one to one basis) in the same class without the New York limitation. The equivalent race would be required on the same day or next race day.

This amendmant was approved by the Board on September 21, 2010 and it will be published as an Adoption in the New York State Register on October 13, 2010. The amendmants will become effective on the date the rule making is published in the New York State Register.

Thoroughbred Padded Riding Crop Rule (4035.9)

Status:

The New York State Racing and Wagering Board has submitted a Notice of Adoption to the New York State Department of State to amend Board Rule 4035.9. This amendment revises the Board's equipment rule for thoroughbred whips, to replace the standard whip with a padded riding crop.

This amendmant was approved by the Board on September 21, 2010 and it will be published as an Adoption in the New York State Register on October 13, 2010. The amendmants will become effective on the date the rule making is published in the New York State Register.

Uncoupling Of Entries with Common Thoroughbred Trainers
(4025.10 & 4035.2)

Status:

The New York State Racing and Wagering Board has submitted a Notice of Adoption to the New York State Department of State to amend Board Rule 4025.10(d) and add a new provision (ii) to Board Rule 4035.2(e). These amendments would allow multiple horses with a common trainer to compete in the same race as separate betting interest, subject to certain restrictions and safeguards.

These amendmants were approved by the Board on June 23, 2010 and they will be published as an Adoption in the New York State Register on July 14, 2010. The amendmants will become effective on the date the rule making is published in the New York State Register.
